To the fullest extent permitted by applicable Philippine law, earph shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the earph Platform, including but not limited to loss of winnings, loss of data, loss of business opportunity, or any other financial or non-financial loss, even if earph has been advised of the possibility of such damages.
earph's total aggregate liability to you for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the amount of funds held in your earph Wallet at the time the relevant cause of action arose.
earph does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. earph provides the Platform on an "as is" and "as available" basis without warranties of any kind, express or implied, to the maximum extent permitted by law.
earph reserves the right to suspend, restrict, or permanently terminate any Account at its sole discretion, with or without prior notice, in circumstances including but not limited to:
Upon termination, earph will return any verified remaining balance in your earph Wallet to your originating payment method, subject to deduction of any amounts owed to earph and completion of any applicable verification requirements.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
In the event of any dispute arising from these Terms or your use of the earph Platform, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the appropriate courts of competent jurisdiction in the Philippines.
For disputes relating to earph's compliance with gaming regulations, Users may file a complaint with PAGCOR through PAGCOR's official complaint channels.
earph reserves the right to amend, modify, or replace these Terms at any time. In the event of a material change to these Terms, earph will notify registered Users via the email address or mobile number on file, and/or by posting a notice on the earph Platform.
Amended Terms will take effect on the date specified in the notice. Your continued use of the earph Platform after the effective date of any amendment constitutes your acceptance of the revised Terms. If you do not agree with any amendment, you must cease using earph and may request the closure of your Account.
